Ct.No.28 as (Rejected) C.R.M. (DB) 2562 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Liluah P.S. Case No.154 of 2021 dated 07.05.2021 under Section 376(2)(i) of the Indian Penal Code and Section 4 of the POCSO Act. In the matter of : Harugopal Goswami.
... Petitioner.
Mr. Subhadip Biswas, Ms. Priyaka Anand Sharma.
...for the Petitioner.
Mr. Bidyut Kr. Roy, Ms. Rita Datta.
...for the State.
Heard the learned Advocates appearing for the parties. Petitioner prays for bail. It is submitted he has been falsely implicated in the instant case.
Learned Advocate for the State opposes the prayer for bail. He submits victim is a deaf and dumb girl. Bail prayer of the petitioner was rejected earlier.
We have considered the materials on record. Victim is a deaf and dumb girl. She indicated through sign language that she was raped by the petitioner. Other materials collected during investigation corroborate her version. In view of the aforesaid incriminating materials, gravity of offence and as bail prayer of petitioner was rejected earlier, we are not inclined to grant bail to him.
Accordingly, the prayer for bail of the petitioner is rejected.
