In the earlier round, respondent no. 7 had approached this Court objecting to the proposed electricity connection in favour of the petitioner. That writ petition was dismissed in light of the fact that a competent Civil Court had already granted relief to the petitioner by allowing the prayer for electricity connection in Misc. Appeal No. 62 of 2017, before the learned District Judge, Hooghly.
By filing the present writ petition, the petitioner has brought to the attention of this Court a communication dated May 30, 2025, wherein the West Bengal State Electricity Distribution Company Limited (WBSEDCL) expressed its inability to effect the electricity connection due to objections raised by local residents.
Respondent no. 7 is represented. It is submitted on his behalf that a revisional application has been filed before this Court challenging the order passed by the learned District Judge.
However, no stay order from the Revisional Court has been produced.
In the circumstances, I am of the view that the electricity connection in favour of the petitioner ought to be effected with police assistance.
Accordingly, this writ petition is disposed of with a direction upon WBSEDCL to effect the electricity connection in favour of the petitioner with the aid of the local police. The petitioner shall comply with all requisite formalities and bear the cost of police assistance.
The entire exercise shall be completed within a period of six weeks from the date of communication of this order.
This order shall, however, remain subject to any order that may be passed by the Revisional Court. It is further clarified that the grant of this electricity connection shall not confer any additional rights upon the petitioner and shall have no bearing on the pending civil suit.
Accordingly, WPA 16595 of 2025 is disposed of.
