S/L 2 02.8.2023 Court No.26 SD WPA 15714 of 2014 Sri Tarun Biswas Vs.

The State of West Bengal & Ors.

Mr. Achyut Basu Mr. Rupchand Chakraborty Ms. Punam Basu Mr. Srikumar Chakraborty ... for the Petitioner.

This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities in recording the name of the petitioner as a lessee as per the application made by the petitioner on August 30, 2013. None appears on behalf of the respondents in spite of service made on several occasions.

Upon perusal of the documents, I am of the view that a decision is required to be taken by the respondent authority at the earliest.

Accordingly, I direct the respondent no.2 to consider the representation made by the writ petitioner on August 30, 2013 upon granting an opportunity of hearing to the petitioner and thereafter, pass a reasoned order within a period of six weeks from date.

The reasoned order should be communicated to the petitioners within a period of one week of passing the same. With these observations, WPA 15714 of 2014 is disposed of.

There will be no order as to costs.

All parties are to act on the website copy of this order.
