Afsar Hossain Mallick v. Indian Oil Corporation Limited & ORS
S/L 8 09.12.2020 Court No.26 SD WPA 15760 of 2019 (Via Video Conference) Afsar Hossain Mallick Vs.
Indian Oil Corporation Ltd. & Ors.
Mr. Timir Baran Saha ... for the Petitioner.
Mr. Puspendu Chakraborty ... for the IOCL.
This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the order dated July 11, 2019 passed by the Indian Oil Corporation with regard to the rejection of the petitioner's application for an award of RO dealership.
Counsel appearing on behalf of the Indian Oil Corporation fairly submits that another opportunity may be given to the petitioner to supply all the documents. He also submits that documents that have been supplied are not complete in all respect.
In light of the above submission, petitioner is directed to submit all the documents that are required by the Indian Oil Corporation within a period of two weeks from date and upon receipt of the same, Indian Oil Corporation is directed to pass a reasoned order within a period of one week. The reasoned order should communicate to the petitioner within a period of one week from the date of passing of the same.
Needless to mention, the order dated July 11, 2019 stands quashed and set aside.
With these observations, W.P.A. 15760 of 2019 is disposed of.
Since, no affidavit-in-opposition has been called for the allegations made in the writ petition are deemed to have not been admitted by the respondents.
There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
