The petitioner was selected as pass graduate teacher in West Karanji Vidyasagar High School in the year 2001.

The school was subsequently upgraded to a Higher Secondary School in 2005. The petitioner had a Post Graduate Degree in Bengali prior to his joining the school.

The District Inspector of Schools (SE), Purba Medinipur by reference to Clause 3 of G.O. No.155SE(B) dated 13th July 1999, as also by reference to G.O. No.593-SE(B) dated 27th November 2007, and Section 14(2) of the West Bengal Schools (Control of Expenditure) Act, 2005, has held that the petitioner is not entitled to a higher pay-scale.

This Court does not find any infirmity with the impugned order, since the petitioner at the time of joining, despite having post graduate degree, consciously joined in a pass graduate post.

In that view of the matter, no relief can be granted to the petitioner.

Hence, the writ petition fails and hereby dismissed.
