W.P.A 15768 of 2019 (Via Video Conference) Hasina Bibi @ Mondal -versus The State of West Bengal & Ors.

Mr. Debasish Chatterjee.

...For the Petitioner.

Affidavit-of-service filed in Court today is taken on record.

None appears on behalf of the State respondents in spite of service.

The petitioner's father expired on 17th May, 1983. The petitioner applied for obtaining the death certificate of her father on 23rd February, 2017.

It appears from records that the Sub-Divisional Officer, Barasat (Sadar), North 24-Parganas directed the Block Development Officer of the Deganga Block by a memo No. 439/SDO(G)/BST dated 27th February, 2017 for issuance of the death certificate.

The petitioner complains that in spite of the aforesaid direction, the Pradhan of the concerned Gram Panchayat is sitting tight over the matter and not issuing the death certificate.

The petitioner made a representation by a letter dated 22nd October, 2018 to the Pradhan of the Gram Panchayat praying for issuance of the death certificate in favour of her father. As the same is kept pending at

the end of the Pradhan, Chakla Gram Panchayat, no useful purpose will be served by keeping the writ petition pending. The same is disposed of by directing the respondent No. 6 being the Pradhan, Chakla Gram Panchayat to take immediate steps for issuance of the death certificate to the petitioner.

The Pradhan shall ensure that the death certificate is handed over to the petitioner positively within a period of eight weeks from the date of communication of a copy of this order.

W.P.A. 15768 of 2019 is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
