A direction to secure expeditious disposal of interlocutory application for amendment filed on 19th May, 2022 in Title suit No. 2 of 2021 pending before the learned Civil Judge (Junior Division), Kakdwip, is the ultimate relief sought for in this case.
No other point is raised requiring address by this Court.
In view of the nature of the order proposed to be made in the case, no prior notice is considered to be necessary.
Service upon the opposite parties is thus dispensed with.
As per submission disclosed by the learned advocate for the petitioner, that the hearing of amendment application has already been scheduled on 10th November, 2022.
That being the position, the revisional application be disposed of, requesting the Court below either to hear out the amendment application on the scheduled date or if for any reason whatsoever, the same could
not be done, the amendment application may be disposed of peremptorily within second week of January 2023, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.
Petitioner is directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties.
With this observation and direction, the revisional application stands disposed of.
Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
