Ct.No.28 as (Rejected) C.R.M. (DB) 2566 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Chanditala P.S. Case No.81 of 2022 dated 11.03.2022 under Sections 498(A)/406/307 of the Indian Penal Code.

In the matter of : Bibhuranjan Halder.

... Petitioner.

Mr. Sudip Ghosh Chowdhury, Mr. Argha Das, Mr. Abhishek Bose.

...for the Petitioner.

Mr. Debabrata Chatterjee, ld. A.P.P., Mr. Santanu Chatterjee.

...for the State.

Heard the learned Advocates appearing for the parties. Petitioner is in custody for about 18 days. It is submitted he has been falsely implicated in the instant case. Learned Advocate for the State opposes the prayer for bail.

We have considered the materials on record including the statements of witnesses which show petitioner had attempted to murder his wife by forcing her to consume poison. Medical papers corroborates such allegation.

In view of the aforesaid incriminating materials on record, we are not inclined to grant bail to the petitioner at this stage. Accordingly, the prayer for bail of the petitioner is rejected.
