This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), 10th Court at Alipore to dispose of the application filed under Order 40 Rule 1 of the Code of Civil Procedure expeditiously.
Learned advocate for the petitioners draws the attention of this Court to an order dated April 29, 2024 passed in C.O. No.1382 of 2024 wherein a Coordinate Bench passed a direction upon the learned Trial Judge to dispose of the application filed under Order 40 Rule 1 of the Code of Civil Procedure within a period of four months from the next date fixed. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned
advocates representing them before the learned Trial Court.
From the order-sheets appended to this revisional application, this Court finds that August 19, 2025 has been fixed for hearing of the application under Order 40 Rule 1 of the Code of Civil Procedure. In the light of the submission made by the learned advocate for the petitioners, C.O. No.2653 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Division), 10th Court at Alipore to make an endeavour to take up the hearing of the application under Order 40 Rule 1 of the Code of Civil Procedure on the next date fixed, if the same is otherwise ready for hearing, and to dispose of the same as expeditiously as possible in the light of the directions contained in the order dated 29.04.2024 passed in C. O. No.1382 of 2024.
