Learned advocate appearing for the petitioners submits that in spite of informing the police authorities regarding illegal construction and threats of the private respondents, no steps have been taken and the same is by way of violating the order of the civil court particularly the orders passed in T.S.73 of 2025 by the learned Civil Judge (Junior Division), 4th Court, Burdwan.

State has submitted a report. Report reflects that an enquiry was conducted wherefrom it reflected that a hot altercation took place. However, an unauthorized construction was taking place which was stopped by the police authorities and a continuous surveillance has been kept.

Having regard to the fact that the police authorities have taken effective steps, petitioners are directed to take out an appropriate application before the civil court for breach or violation of the order of the civil court. It is further directed that police authorities would continue their surveillance and ensure that no untoward incident results from the inimical relationship existing between the petitioners and the private respondents.

With the aforesaid observations, WPA 16597 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
