Damodar Valley Corporation and others Mr. Pratik Dhar, Mr. Ritwik Pattanayak .... for the WBERC When the matter is called on for hearing, none appears for the petitioner or the other respondents apart from the West Bengal Electricity Regulatory Commission (WBERC).

The learned Senior Advocate appearing for the WBERC submits that the Regulation, which is under challenge in the present writ petition has, since, been repealed.

In such view of the matter, the writ petition has become infructuous.

Accordingly, WPA No. 13378 of 2012 is dismissed as infructuous without any order as to costs.
