The facts of the case is that the petitioner was granted anticipatory bail by Court of Sessions Judge, Murshidabad being Criminal Case No. 5563 of 2020.

The condition of the order granting anticipatory bail was that the petitioner has to surrender within a period of one month from the date of the said order. As the petitioner failed to surrender warrant of arrest was issued.

Upon perusal of the order and considering the facts of the case it appears that as the petitioner was required to surrender within one month from the date of the order any extension to be sought is to be by way of application before court which was passed the order of anticipatory bail.

Thus the revisional application before this court not maintainable. The petitioner in such a case as liberty to take steps in accordance with law.

It is, however, made clear that this court has not gone into the merits of the case and all points are kept open to be agitated by the petitioner before the competent court.

The Revisional Application stands disposed of. (Biswaroop Chowdhury, J. )
