It appears from the submission made on behalf of the petitioner and the concerned respondent which is respondent no. 3, i.e., National Institute for Locomotor Disabilities (NILD) and the material placed before the Court that letter by the Deputy Director to the Government of India to the In-charge, Director of National Institute for Locomotor Disabilities (NILD) dated 23rd September, 2016 has admittedly not acted upon by the latter. This would appear from the specific request contained in the letter that the National Institute for Locomotor Disabilities (NILD) would have to examine and submit its proposal for revision of the Recruitment Rules for the post of Associate Professor in Occupational Therapy in similar line as revised for the identical post in Orthopedics, Prosthetic and Orthotic.
The document placed on behalf of Director of National Institute for Locomotor Disabilities (NILD) showing the Recruitment Rules for Associate Professor in Occupational Therapy are the Rules before the submission of proposal by Director of National Institute for Locomotor Disabilities (NILD) as requested in the letter of 23rd September, 2016.
Secretary to the Government of India. Counsel submits that revised proposals for the other departments have already been given effect to.
In view of the above, and by reason of the admitted facts that the letter of 23rd September, 2016 has not been acted upon by Director of National Institute for Locomotor Disabilities (NILD) till date. The respondent nos. 3 & 4 are directed to act upon the letter dated 23rd September, 2016 and submit the proposal for revision of Recruitment Rules for the post of Associate Professor in Occupational Therapy within a period of six weeks from date. It is made clear that besides respondent nos. 3 and 4 if other authority is empowered to submit the proposal as directed, Director of National Institute for Locomotor Disabilities (NILD) shall ensure that the said authority complies with the direction of the Court within the stipulated time framed. A copy of the proposal shall be made available to the petitioner within a week from which such proposal is submitted.
WPA 17717 of 2021 is disposed of in terms of the above.
