The present challenge is confined to the delay in adjudication of the challenge preferred before the Tribunal by way of OA No. 2865 of 2024 as well as the connected stay application bearing Miscellaneous Case No. 1495 of 2024.

Learned counsel appearing for the petitioner argues that although the stay application was initially taken up for passing orders, due to the

demise of one of the parties, a substitution application had to be taken out. Even after the same was allowed, the miscellaneous application for stay was postponed for hearing along with the main OA and the next date has been fixed on May 14, 2026, which is about one year hereafter. It is contended that the valuable rights of the petitioner will be affected due to the inordinate delay in postponement of the stay application.

Heard learned counsel for the petitioner, the State as well as the private respondent. At this stage, there is no scope of entering into the merits of the respective contentions of the parties in the OA. However, it is apparent from the nature of the matter that there is urgency involved, at least with regard to the stay application pending before the Tribunal. 4.

Accordingly, WPLRT 112 of 2025 is disposed of by directing the West Bengal Land Reforms and Tenancy Tribunal to dispose of Miscellaneous Case No. 1495 of 2024, pending before it in connection with OA No. 2865 of 2024, as expeditiously as possible, positively within three weeks from the date of communication of this order to the said Tribunal, upon giving an opportunity of hearing to all the parties.

Upon disposal of the same, the Tribunal shall endeavour to hear out and dispose of OA No. 2865 of

2024 as expeditiously as possible, by preponing the dates, preferably within December 31, 2025.
