Mr. Shibendra Nath Chattopadhyay, Mr. Priyam Misra ... for the petitioner Mr. Dipanjan Sinha Roy ... for the respondent nos. 1 to 5 Mr. Debasish Ghosh, Mr. Ratul Das ... for the State The only reason for the petitioner coming before the Court for permission to hold a 'Goat Bazar' during the Eid-Uz-Zoha in 2023 is rejected on 29th June, 2022 from the Joint Commissioner of Police, Headquarters, Kolkata stating that the permission is accorded to a person/group who approached the authorities before the petitioner.

According to learned counsel for the petitioner, the dates for the 'Eid-Uz-Zoha' have already been declared from 22.06.2023-29.06.2023. The petitioner in effect wants to be the first one to apply for permission in the venue, which belongs to the Army.

Learned counsel appearing for the State submits that the petitioner would first have to apply to the State authorities with certain particulars and then before the Army since the land belongs to the Army. Permission would then be considered on the basis of the documents submitted by the petitioner.

WPA 17187 of 2022 is disposed of with liberty to the petitioner to approach the State authorities with certain documents and apply for permission. The petitioner would be at liberty to follow through with the accepted procedure for permission to hold 'Goat Bazar' during the designated days. The respondents shall also be at liberty of considering the application of the petitioner based on the relevant criteria, which are applied to all intending persons.
