1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the mother-in-law of the victim/deceased. The husband being the prime accused was arrested and thereafter granted bail. Another co-accused has been granted anticipatory bail. The incident took place after 10 years of marriage.

2. Learned counsel appearing for the State opposes the prayer for anticipatory bail and relies on the case diary. He points to the statements of the relatives of the victim as well as the neighbours of the victim.

3. It is surprising that no statement has been recorded of any neighbour of the accused or of the child of the victim.

4. Be that as it may, considering the materials available in the case diary and the fact that the prime

accused/husband was arrested and he is presently on bail and considering the alleged role ascribed to the present petitioner, I am inclined to grant anticipatory bail to the petitioner.

5. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate witnesses.

6. Accordingly, the application for anticipatory bail is allowed.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
