It is a case where the petitioner prayed for an appointment on the basis of a recommendation letter regarding which the School Service Commission stated in their report filed before this court that such recommendation letter was not issued by the Commission.

This court held that the petitioner could not be treated as a recommended candidate by the Commission and the petitioner was directed to come up

with an affidavit with certain particulars which was clearly recorded in the order dated 2nd February, 2022 and such affidavit was to be filed today.

Today Ms. Singh submits that such affidavit is not ready and the advocate on record is ill and has not come to court.

Learned advocate on record may be ill, but I do not understand why the petitioner has not taken any step for filing the affidavit through Ms. Singh who appeared on the last occasion and is also appearing today.

I hold that the petitioner has clearly failed to comply with the order of this court and has failed to disclose the names or designations of the persons etc. who handed him over the recommendation letter and the appointment letter.

Hence, no further opportunity can be given to the petitioner for filing such affidavit and the writ application is dismissed.
