Learned counsel for the petitioner contends that, despite having complied with all formalities, the petitioner has not been given a new electric connection by the respondent authorities.

Such contention is controverted on behalf of the Distribution Company, that is, the CESC Limited, which takes a stand that, although an offer was given previously to the petitioner to crease out the issues standing in the way of giving such electric connection, the petitioner did not take any steps in that regard.

As such, a fresh inspection and assessment of the requisite charges is necessary in order to give an electric connection to the petitioner.

Learned counsel for the petitioner, in his usual fairness, submits that his client is agreeable to co-operate

with the CESC authorities for such fresh inspection and assessment of charges accordingly.

In such view of the matter, WPA 17729 of 2021 is disposed of by directing the respondents to hold an inspection at the premises-in-question within a week from date for the purpose of assessing the appropriate location and electricity charges in respect of the meter to be installed at the petitioner's premises.

The petitioner and his men and agents shall fully cooperate with the officials of the CESC Limited in completing such inspection.

The CESC Limited will thereafter revalidate the security bill as well as offer letter dated April 21, 2016, subject to compliance of all formalities and clearance of dues by the petitioner as per the assessment of the CESC Limited.

In the event of such compliance on the part of the petitioner, the CESC Limited will give such new electric connection to the petitioner's premises within a fortnight after such compliance.

W.P.A. No. 17729 of 2021 is disposed of accordingly.

The parties shall act on the server copy of this order instead of insisting upon prior production of a certified copy.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
