Mr. Neil Basu Mr. Abhrajit Roy Chowdhury ... for the petitioner Mr. Arindam Chattopadhyay Ms. Lipika Chatterjee ... for the State Mrs. Nandini Mitra Ms. Shaika Khan ... for respondent no. 6 It is the grievance of the petitioner that her prayer for Child Care Leave was not allowed by the college with a vindictive attitude.

It is submitted that the petitioner prayed for Child Care Leave for the period of 14.11.2022 to 28.11.2022, but the College has treated the said period as Earned Leave in denial of her entitlement to Child Care Leave. Mrs. Mitra, learned counsel appearing for the respondent no. 6 submits that in the said application for Child Care Leave the petitioner could justify the Child Care Leave for ten days only, and for the remaining five days, no reason was provided.

Be that as it may, it has been submitted by Mrs. Mitra that the College has agreed to treat the entire period of fifteen days as the Child Care Leave as a special care without creating any precedence.

In that view of the matter, the instant writ petition is disposed of with a direction upon the College to treat the aforesaid period as a Child Care Leave of the petitioner.

There will be however no order as to costs.

Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Kausik Chanda, J.)
