The present revisional application is in respect of a prayer with regard to transferring the proceedings of Misc. Case No. 448 of 2014 which is pending before learned Judicial Magistrate, 6th Court, Burdwan relating to the provisions of P.W.D.V Act, 2005. The grounds so assigned in the revisional application for transferring the proceedings are ailing condition of the petitioner no.2 and the petitioner no. 1 having no income of his own. As such, he is unable to bear the cost of transportation and other charges.

Having considered the reasons so assigned in the revisional application under Section 407 of the Code of Criminal Procedure, I am of the opinion that none of the grounds are acceptable for transfer. The case was initiated in the year 2014 and for the last nine years the same is pending before the court. The present revisional application has been preferred only on the object of delaying the proceedings before the learned trial court. As such, no interference is called for.

With the aforesaid observations, the present revisional

application being CRR 2603 of 2023 is dismissed. Pending applications, if any, are consequently disposed of All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
