The petitioner is in custody for about two years and seven months and prays for bail.
Learned counsel for the petitioner submits that the other coaccused have been granted bail earlier. He is not responsible for the death of the victim. His further detention is not required. Learned counsel for the State opposes the prayer. I have considered the material on record. The victim appears to have committed suicide. The petitioner is the husband of the victim. There are allegations of disputes between the petitioner and the victim. Whether the conduct of the petitioner can be said to be the proximate cause for commission of suicide by the victim shall be assessed at the appropriate stage of the proceeding. Charge sheet has been submitted. 3 out of 21 witnesses have been examined. Further detention of the petitioner is not necessary. He may be released on bail.
Accordingly, the prayer for bail is allowed.
The petitioner namely Sukmol Besra @ Sukamal Besra be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten
Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Gangarampur at Buniadpur subject to the condition that he shall appear before the learned trial Court on every date of hearing. He shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
