This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Division), 2nd Court, Barrackpore to dispose of the Title Suit No.417 of 2019 expeditiously.

The learned advocate for the petitioner submits that on an earlier occasion, a Coordinate Bench passed an order on 22.08.2022 in C. O. No.1818 of 2022 requesting the learned Trial Judge to dispose of the suit expeditiously. He submits that in spite of such order, no effective step has been taken by the learned Trial Judge to dispose of the Title Suit expeditiously. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties. However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned Trial Court.

From the order-sheet appended to this revisional application, this Court finds that on 09.04.2025 an application for vacating the ex parte hearing of the suit was allowed subject to payment of costs.

It further appears from the order sheet appended to this revision application that August 4, 2025 has been fixed for payment of costs.

In the light of the submission made by the learned advocate for the petitioner, C.O. No.2661 of 2025 is disposed of by requesting the learned Civil Judge (Junior Division), 2nd Court, Barrackpore to make an endeavour to dispose of the Title Suit No.417 of 2019 as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
