Learned advocate appearing for the petitioner submits that, other co-accused was granted bail by the Jurisdictional Court.

Learned advocate appearing for the State draws the attention of the Court to the statement of the eye witness of the incident recorded under Section 161 of the Code of Criminal Procedure (Cr.P.C.).

The statement of the eye witness referred to by the learned advocate appearing for the State squarely implicates the petitioner. There is another statement of another eye witness stating that the petitioner was seen running away with the blood stained sharp cutting weapon.

Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 3670 of 2022 is dismissed.
