1. Supplementary affidavit filed in Court is taken on record.

2. The facts of the case are recorded in detail in the order dated 10th July, 2024. The Commissioner of School Education, West Bengal has filed instructions addressed to State Advocate dated 11th July, 2024, which is taken on record.

3. It appears from the instructions of the Commissioner of School Education, West Bengal that since there is no scope to accommodate enough candidates in government sponsored and government aided DIET and PTTI institutions, the petitioners may undergo two years mandatory training through government recognized private self financed institutions, in

addition to government sponsored and government aided PTTIs and DIET course imparting institutions.

4. Insofar as the candidates, who have been recruited under orders of Court and who are writ petitioners herein, the absence of 50 per cent marks in the higher secondary examination shall not stand in the way of their undergoing the aforesaid two years training course as already indicated herein above.

5. The aforesaid deviation from the Rules of NCTE is made as a special case in view of the special circumstances under which the writ petitioners have been recruited i.e. through orders of this Court and also the Hon'ble Supreme Court. The concerned DPSC, Board and/or the Commissioner of School Education, West Bengal shall publish a list of government recognized self financed private institutions imparting the aforesaid PTTI and DIET courses on the website of the Board as well as the Council forthwith.

6. The last day for submission of online applications for undertaking the aforesaid courses is extended until 20th July, 2024.

7. With the aforesaid observations, the writ petition is disposed of.

8. There will be no order as to costs.

9. All parties are to act on a server copy of this order duly downloaded from the official website of this court.
