The present proceedings relate to a challenge in respect of complaint case No. 39077 of 2015 under Section 138/141 of the Negotiable Instruments Act which is pending before the Learned 6th Metropolitan Magistrate at Calcutta. Mr. Pawan Kr. Gupta, learned counsel appearing for the petitioner submits that he is no way associated with the company/firm in respect of whom allegedly the complainant has said that cheque was issued in their favour. I find that the complaint case was filed in the year 2015 and dates were fixed for examination under Section 251 of the Code of Criminal Procedure and in the meantime warrant of arrest was issued against the present petitioner. I grant liberty to the petitioner to canvas the points which have been advanced in the present revisional application at the stage of Section 251 of the Code of Criminal Procedure before the learned 6th Metropolitan Magistrate, Calcutta.

The warrant of arrest so issued be kept in abeyance till 14th July, 2023, if the petitioner appears/surrenders and then prays for bail before the

learned Magistrate, the learned Magistrate will allow him to continue on the same bail and bond.

With the aforesaid observations, CRR 2752 of 2022 is disposed of.

Pending applications, if any, is consequently disposed of.
