1. Heard the learned counsels for the parties.

2. Perused the case diary.

3. It is contended by the petitioners that there is a property dispute between the co-sharers. A scuffle took place on a few occasions. There are case and counter case.

4. Learned counsel appearing for the State opposes the prayer for anticipatory bail. However, she submits that charge-sheet has been submitted.

5. Considering the materials available in the case diary and the fact that there are case and counter case and that charge-sheet has been submitted, I am inclined to grant anticipatory bail to the petitioners.

6. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two

sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate witnesses. The petitioners shall surrender and pray for bail before the learned jurisdictional Court within four weeks from date and shall attend the jurisdictional Court regularly. The petitioners shall stay outside the jurisdiction of Daspur Police Station for a period of two months from date except for attending the jurisdictional Court.

7. Accordingly, the application for anticipatory bail is allowed.

8. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
