The allegation of the petitioner is that the R.S. plot no.415 comprising to R.S. Khatian No.261 is a water body being used by the common people of Sirajbati area for domestic purpose but the private respondents are filling up the said water body and raising multi-storied construction thereupon.

When the matter is taken up today learned counsel for the petitioner has submitted that a mass representation dated 30th June, 2022 (annexure-P5) has already been submitted before the respondent no.3, District Magistrate, therefore a direction be issued to decide the said representation.

Learned counsel for the State has no objection to such a prayer.

Hence, the present writ petition is disposed of by directing the respondent no.3 to duly consider the petitioner's representation dated 30th June, 2022 and to get the enquiry done in respect of the allegation

contained therein and pass an appropriate order after giving opportunity of hearing to the concerned parties. Let this exercise be completed within a period of three months from the date of receipt of a copy of this order.
