Petitioner is directed to serve a copy of the revisional application upon Mr. Koushik Kundu, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Learned advocate appearing for the petitioner is anxious regarding the factum of the petitioner being in custody since 2nd June, 2022. Learned advocate for the petitioner submits that the chargesheet was submitted in the month of November,2022, charge was framed on 1st March, 2023 and out of the 13 witnesses proposed to be examined by the prosecution, five witnesses have been examined till date.

Having regard to the nature of progress of the trial, I am of the view that the learned special court has taken efficient efforts for progressing of the trial. However, the accused being in custody obviously would be anxious regarding the final outcome.

Consequently, I direct that the learned trial court will not grant any unnecessary adjournments to either of the parties. The Public Prosecutor appearing in the case would produce the materials, documents and exhibits on the dates fixed for examination of the witnesses concerned. If there is any impediment for appearance of any witness, the learned trial court would seek assistance of Superintendent of Police of the concerned District who would ensure regarding the production of the witnesses on the dates so fixed.

If required, the learned trial court would fix a schedule of three dates and fix a schedule once in every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, the present revisional application being CRR 2604 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
