It is said by the learned Advocate that she has already filed vakalatnama before the department on behalf of the appellant-complainant in this case.

The department is directed to tag the said vakalatnama with this record at once.

Respondents nos. 1,2, 3 are represented by the learned Advocate. 5.

Respondent no. 4, State is represented.

It is said by the learned Advocate that the matter in dispute has already been settled outside of the Court and this appellant-complainant does not intend to proceed further with this appeal.

The learned Advocate for the respondents has also conceded the said amicable settlement between them.

The instant appeal is preferred challenging the impugned judgement and order passed by the learned Trial Court dated 7.8.2001, in connection with case no. 2014 of 1997. By passing the impugned judgement and order the accused persons were found not guilty for commission of offence.

I have gone through the said judgement by the learned Trial Court and find nothing to interfere with the said impugned judgement.

10. Accordingly, the instant appeal be and the same is dismissed on merit.

11. The judgement and order of acquittal passed by the learned Trial Court dated 7.8.2001 in connection with case no. 2014 of 1997 is heareby affirmed.

12. Thus, the instant appeal being CRA 470 of 2001 is hereby disposed of.

13. Let a copy of this order alongwith Trial Court Record be sent down to the learned Trial Court immediately.

14. Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities. (Prasenjit Biswas, J.)
