The instant appeal arises out of an order of acquittal dated 23.08.2001 passed by the learned Metropolitan Magistrate, 3rd Court, Kolkata in Case No. 2249 of 1997 under Section 138/141 of the Negotiable Instrument Act, 1881.

In the above premises, the instant appeal is dismissed for nonprosecution. The personal appearance of the appellant as well as opposite party Nos. 1 and 2 are noted and dispensed with. Copy of the order and lower court records be sent to the trial court for due compliance.
