The writ petitioner has prayed for issuance of a writ in the nature of mandamus commanding the respondents to refrain from giving any effect to the order passed by the Sub-divisional Officer, Ghatal on August 29, 2021, the order passed by the District Magistrate in Misc. Appeal No.2 of 2021 on August 24, 2021 and the order contained in Memo No.114 dated September 9, 2021 passed by the Assistant Engineer, Ghatal Highway Sub-division, PWD Roads Directorate.

It is submitted by the learned counsel for the petitioner that during pendency of the writ petition, the said orders under challenge have been given effect to by the State respondents who have demolished the residential building of the petitioner in the plot in question.

The petitioner intends to challenge the legality of such demolition in a fresh writ petition.

In view of the above, nothing further remains to be adjudicated in the present writ petition, which has become infructuous.

Accordingly, the writ petition being WPA 17778 of 2021 is dismissed as infructuous.

There shall be no order as to costs.
