The Hon'ble Justice Bibek Chaudhuri CRR 2757 of 2022 Jaya Banerjee Vs.

The State of West Bengal & Anr.

Mr. Sankar Banerjee ....for the petitioner Item No.57 Heard & Judgment on:

01.09.2022 Bibek Chaudhuri, J.

On the basis of an FIR dated 8th December, 2019 Lake Town Police Station Case No.231 of 2019 was registered against one Arijit Majumder, since deceased.

It is pertinent to mention that Arijit Majumder, since deceased, was the husband of the de facto complainant. Accused Avilash Majumder is his unmarried brother-in-law. The de facto complainant/petitioner has been pursuing the criminal case against the opposite party No.2 Avilash Majumder. The de facto complainant/petitioner has filed the instant revision praying for expeditious disposal of the G.R. Case No.989 of 2019.

It appears from the certified copy of the orders passed by the learned Additional Chief Judicial Magistrate, Bidhannagar in G.R. Case No.989 of 2019 that the learned Magistrate fixed 20th March, 2020 for appearance of the accused persons and supply of the copy under Section 207 of the Code of Criminal Procedure. Subsequently, the accused persons were present but the Court failed to supply the copy in compliance of Section 207 of the Code of Criminal Procedure till date. Trial of the case is being dragged for non-compliance of Section 207 of the Code of Criminal Procedure.

In view of such circumstances, the instant revision is disposed of directing the learned Additional Chief Judicial Magistrate, Bidhannagar to supply the copies of the documents

under Section 207 of the Code of Criminal Procedure positively within 15th September, 2022 to the opposite party No.2. The learned Magistrate is further directed to fix the case for consideration of charge within 15 days after the puja vacation and conclude the trial of the case within one year thereafter.

With the above order the instant revision is disposed of.
