1. On behalf of the petitioner it is submitted that the present accused petitioner has been falsely implicated and even subsequent to the filing of the FIR, the name of the present accused petitioner was not taken up. He prays for bail.

2. While opposing the prayer for bail learned Counsel for the State submits that involvement of the present accused petitioner is found from source information. It is further submitted that incriminating material has been seized from the possession of the present accused petitioner connecting him with the crime including the alleged offending firearm.

3. Considering the entire materials placed before us and in view of possible extent of complicity of the petitioner in the alleged crime, we are not inclined to exercise our discretion Signed By :

under Section 439 Cr.PC in favour of the petitioner's prayer for bail. The prayer for bail is rejected.
