Petitioner approached this Court being aggrieved 11.08.2025 Court No. 35 M/L. No.770 Rakib by the inaction of the police authorities in spite of receipt of the representation which was addressed to the Inspector-in-Charge of Madhyamgram PS on or about 06.07.2024.
State has submitted a report. Report reflects that a case was registered being Chatterjeehat PS case no. 192/23 dated 28.09.2023, subsequently on conclusion of investigation Chatterjeehat police station submitted charge-sheet. There was subsequently representation which was submitted. One Sudipto Kr. Chakraborty also filed a case before the Chatterjeehat Police Station wherein the police authorities registered a case being Chatterjeehat PS case no. 20/24 dated 02.02.2024 and on conclusion of investigation charge-sheet was submitted under the relevant provisions of law. A communication was received by Chatterjeehat Police Station to the effect that the husband of the petitioner's daughter would go to Madhyamgram to murder them and to that effect the letter was sent to Madhyamgram Police Station.
On consideration of the totality of the circumstances, I am of the view that there is a matrimonial dispute and from the aforesaid, two criminal cases were registered. The present representation which is the subject matter of the writ petition is on the basis of an apprehension and threat. If such apprehension, threat and insecurity still continues, I am of the view that a fresh representation be submitted by the petitioner before the concerned Court which is in seisin of the criminal cases. Learned Magistrate would deal with the same in accordance with law and if required pass necessary directions under the Witness Protection Scheme, 2018. With the aforesaid observations WPA 17636 of 2024 is disposed of.
Report so submitted by the State be kept with the record.
