Ms. Sujata Mukherjee ... for the State-respondent in WPA 16726 of 2023 The agony and anxiety as has been expressed by the petitioner is in respect of the absconding accused persons.

It is reflected from the Report submitted by the State that one of the accused persons being the respondent no.10 in the writ petition has been arrested;

charge(s) has been framed against him and date has been fixed for

evidence of the defacto-complainant.

So far as the Respondent No.9 - Subarna Hizra;

Respondent No.11 - Kumkum Kamal Hizra and Respondent No.

12 - Tumpa Hizra are concerned, they have been found to be absconding and have been declared as proclaimed offenders.

Since trial has again resumed in connection with the Sessions Case, the learned trial court already in seisin of the case would call for a report on each and every date of the scheduled dates so fixed by the said trial court in connection with Shyampur P.S. Case No. 373 of 2015 (Sessions Trial Number 161U/2016).

The investigating officer of the case on each of the date so fixed by the learned trial court (which should not exceed once in a month) submit the steps taken for tracing out the three absconding accused persons named above in the form of a

report before the trial court.

In case, the learned trial court finds that evading measures have been taken by the police authorities, the trial court would direct the superior officer of the police to monitor the same.

The petitioner complains that there are threats for which she is feeling insecure. If she files an application before the Superintendent of Police, Howrah and, in case, the Superintendent of Police, Howrah feels that there are threat perception, then, in that case, necessary measures be extended to the petitioner.

In view of the observations made above, further pendency of the writ petition is unwarranted.

Accordingly, WPA 16726 of 2023 and WPA 14411 of 2022 is disposed of.

Report so submitted be kept with the record. Copy of the report be handed over to the petitioner.
