Mr. Arup Kumar Bhowmick ....for the petitioner Mr. Bitasok Banerjee Mr. Parvez Anam .....for the State Report filed on behalf of the petitioner is taken on record. Learned counsel appearing on behalf of the petitioner submits that other than the statement of a co-accused, which is inadmissible in evidence, there are no other incriminating materials available against the petitioner.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the case diary and the report and submits that other than the statement of a co-accused there are criminal antecedents of the petitioner being Kaliachak P.S. Case No. 365 dated 10.04.2022 under Sections 22(c), 27A and 29 of the NDPS Act and Kaliachak P.S. Case No. 784 dated 04.10.2012 under Sections 489(B) and 489(C) of the Penal Code. Considering the incriminating materials available in the case diary, the criminal antecedents of the petitioner and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
