Supplementary affidavit filed on behalf of the petitioner is taken on record.
The petitioner is in custody for more than a year and prays for bail.
Learned counsel for the petitioner submits that she has been falsely implicated.
Learned counsel for the State opposes the prayer. I have considered the material on record. It prima facie appears that the petitioner's name has not transpired in the statements of the witnesses as one of the assailants. Trial is in progress. Material available in the Case Dairy does not justify further detention of the petitioner.
Accordingly, the prayer for bail is allowed.
The petitioner namely Chumki Haldar @ Mamata Sarkar Halder be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned
Additional Chief Judicial Magistrate, Ranaghat, Nadia subject to the condition that she shall appear before the learned trial Court on every date of hearing. She shall not intimidate witnesses or tamper with evidence in any manner whatsoever. In the event the petitioner fails to appear before the learned trial Court on any date without justifiable cause, the learned trial Court shall be at liberty to cancel her bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
