S. De C.P.A.N. 1396 of 2022 in M.A.T. 967 of 2018 Smt. Mira Sarkar.

Vs Khali Ahmed & Anr.

Mr. Debasish Chattopadhyay, Mr. Gobinda Chandra Baidya, Mr. Tirthankar Basu, ...for the appellant.

This contempt application has been taken out alleging willful violation of a judgment and order dated March 25, 2022 whereby MAT 967 of 2018 was disposed of.

The operative portion of the said order reads as follows :- "Accordingly, the appellant shall be at liberty to pay the requisite amount to the Government within two months from date. Upon receipt of such amount, the Government shall immediately and not later than eight weeks thereafter, execute a Lease in favour of the appellant in respect of the plot in question. Needless to say that, mutation charges and other applicable charges shall

also be paid by the appellant.

The appellant shall ascertain from the concerned authority, the exact amount that she has to pay. Any query raised by the appellant, shall be promptly responded to by the concerned authority."

Learned advocate for the petitioner says that in spite of having held a hearing on April 25, 2022 at the office of respondent no.2, the petitioner has not been informed the amount of money that she has to pay for getting the fresh lease executed in her favour.

Let copies of the contempt petition be served on the alleged contemnors and affidavit-of-service be filed on the next date. List the matter again on January 24, 2023.
