The petitioner is aggrieved by the act on the part of WBSEDCL in providing electricity connection to the private respondent for operating submersible pump within a distance of twenty feet from the pump that is being operated by the petitioner.

2. It has been brought to the notice of the Court that the connection of the private respondent falls within the 'safe zone' as per the report of the Dynamic Ground Water Resources of West Bengal prepared by the Central Ground Water Board, Eastern Region, Government of India and the State Water Investigation Directorate, Government of West Bengal.

3. As there is no bar in granting electricity connection for operation of submersible pump in the 'safe zone', accordingly, the prayer sought for by the petitioner cannot be allowed.

4. The writ petition fails, and is hereby dismissed.

5. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
