It is submitted on behalf of the petitioner that he is in custody for about three years. Learned advocate appearing for the State opposes the prayer for bail and submits petitioner is the owner of the vehicle which was used to transport narcotic.

We have considered the materials on record. Statements of witnesses as well as contemporaneous document seized in course of investigation namely, sale agreement reveal petitioner is the owner of the vehicle which was used to transport narcotic above commercial quantity. His prayer for bail was rejected earlier. Under such circumstances and in view of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined in granting bail to the petitioner. The application for bail is thus rejected.

Trial court is directed to expedite the trial and conclude the same at an early date.
