The petitioner complains that the private respondent by force trying to encroach his property. Counsel for the private respondent submits that they are also entitled to some portions of the same either as co-sharer or by purchaser.

The matter is purely civil in nature and the demarcation of the property between the petitioner and the private respondent is required to be done under a Civil Court's order that of a statutory authority. The police have no role to play in this matter.

Without interfering in any way into the civil rights of the parties in respect of the property, the officer-in-charge, Sagardighi Police Station shall ensure that there is no breach of peace in the area. The parties shall abide by any decision by any civil forum in respect of the suit property.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
