Mr. Saryati Datta ...For the State The learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. It has been alleged that there has been a recovery of 5 kgs. of Ganja from her possession. Upon completion of investigation, charge sheet has already been submitted and as such further detention of the petitioner, who is in custody for 383 days, is not necessary.

The learned advocate for the State opposes the prayer for bail of the petitioner and submits that there are materials on record, which clearly reveal the direct involvement of the petitioner in the alleged offence and that she had been a part of the racket.

Having heard the learned advocates appearing for the respective parties and considering the materials in the case diary, including the statements of the witnesses, the gravity of the offence and the extent of complicity, we are of the opinion that the rigours of section 37 of the N.D.P.S. Act are attracted and in view thereof, the petitioner's prayer for bail is refused at this stage.

The application for bail, being CRM No. 7345 of 2021, is, accordingly, disposed of.
