Report submitted by the State is taken on record. The petitioner is in custody for more than four years and prays for bail.
Learned counsel for the petitioner submits that the case is based on circumstantial evidence. The victim appears to have been strangulated to death. The petition has not been implicated in the alleged offence by any of the witnesses.
Learned counsel for the State opposes the prayer. I have considered the material on record. The petitioner and two others were last seen together with the victim prior to the alleged incident. The petitioner has been identified in T.I. Parade. Two witnesses have named the petitioner to be present at the place of occurrence prior to the incident and they have apparently seen a scuffling between the petitioner and two others on one hand and the victim on the other hand. These two witnesses are yet to be examined. The petitioner is in custody for more than four years. Offence, if proved, shall attract mandatory life imprisonment. 7
witnesses have been examined. The prosecution proposes to examine 17 more witnesses.
Considering the material on record and prima facie involvement of the petitioner in the alleged offence, prayer for bail is rejected at this stage.
Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties. The application for bail is disposed of.
