Sk Maula Ali And Another v. State Of West Bengal And ORS.
D/L. 6.
August 7, 2023.
MNS.
WPA No. 17801 of 2021 Sk. Maula Ali and another Vs.
The State of West Bengal and others Mr. Kallol Kumar Maity ... for the petitioners.
Affidavit-of-service filed in Court today be kept on record.
Despite service, none appears on behalf of the respondents.
The prayer of the writ petitioners is innocuous. The writ petitioners applied for a certified copy of a deed. However, when the certified copy was issued, it was observed by the petitioners that there is no statutory endorsement on the last page of the same, regarding Book Number, Volume Number, pages, year etc.
Accordingly, WPA No. 17801 of 2021 is disposed of by directing the respondent no. 4, that is, the Additional District Sub Registrar, Contai-I, to issue a fresh certified copy to the petitioners on the basis of the application already made by the petitioners in terms of the representation dated September 1, 2021, given
by the petitioners, which is annexed at page 46 of the writ petition (Annexure P2), within one month from the date of communication of this order to the said respondent.
The said fresh certified copy, needless to say, shall contain all relevant details as indicated above.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
