AD-11 Ct No.16 31.01.2025 (SSS) CO 2462 of 2024 Ayush Khandelwal Vs.

Vartika Khandelwal Ms. Sanchari Chakraborty, Ms. Puja Dey ....For the Petitioner.

1.

By the present application under Article 227 of the Constitution of India, a direction for expeditious disposal of a matrimonial suit has been sought by the petitioner/husband. Learned Counsel appearing for the petitioner submits that unnecessary adjournments galore have been granted by the trial court, as such, unnecessarily and inordinately delaying the matrimonial proceedings.

2.

We find from the records that the matter is still pending for framing of issues and the suit has only been filed in the year 2023. Hence, no aspersion can be cast on the trial court for delaying the hearing of the suit.

3.

However, considering the urgency implicit in any matrimonial proceeding, learned Counsel for the

petitioner is somewhat justified in submitting that adjournments should be granted in a strict manner. 4.

Accordingly, CO No. 2462 of 2024 is disposed of by requesting the learned Additional District and Sessions Judge, Second Court at Sealdah, District - South 24 Parganas to make endeavour to dispose of Matrimonial Suit No. 07 of 2023 pending in the said court as expeditiously as its business permits, without granting any unnecessary adjournment to either of the parties.

5.

No order as to costs.
