...for the Petitioner.
Mr. Saibal Bapuli, ld. A.P.P., Mr. Bibaswan Bhattacharya.
...for the State.
We are informed Director, CFSL is not in Kolkata. Deputy Director, CFSL is present before us. He submits explanation with regard to delay in examination of samples. From the report submitted by the Director, we take note that eight (8) new posts have been sanctioned which are likely to be filled up by December, 2022. This would considerably reduce the time taken for analysis of samples. Explanation is kept on record.
Chemical examiner's report pertaining to the present case is also filed. Report states presence of Methamphetamine in the seized samples.
In view of the report and the other materials on record implicating the petitioner, we are not inclined to enlarge him on bail.
Accordingly, the prayer for bail of the petitioner is rejected.
Presence of the Deputy Director, CFSL is noted and dispensed with.
Trial court is directed to proceed with the trial with utmost expedition and conclude the same at an early date without granting unnecessary adjournments to either of the parties.
