Tapan Kumar Dey and Ors.

Mr. Piyus Chaturbady, Senior Advocate Mr. Vinayak Chaturbady Mr. R. Banerjee Mr. I. Paul .... For the Review Applicant.

Ms. Puja Beriwal Ms. Amrita Panja Moulick .... For the Respondent No.1.

Mr. Sandipan Banerjee Mr. Ankit Sureka .... For the Howrah Municipal Corporation.

Ms. Debjani Sengupta Ms. Poulomi Ghosh .... For the Writ Petitioner/Respondent.

1.

Review is sought of this Court's order dated 1st July, 2025 on the ground that the old structures also directed by this Court to be demolished based on the report of the Howrah Municipal Corporation, exception whereto taken by the review applicant was not considered.

2.

This Court notes that the exception was on record and must be deemed to have been considered by this Court. What is vital and explicit from the order dated 1st July, 2025 is that the club in question existed only since 1984 and, therefore, could not have knowledge of any prior sanction or existence of any structure or temple thereat prior thereto.

3.

This Court finds absolutely no reason to review the order in question.

4.

Learned counsel for one of the respondents has placed an order of the Hon'ble Supreme Court dated 25th August, 2025 passed in Petition(s) for Special Leave to Appeal (C) No(s).23608 of 2025 which has dismissed the Petition(s) for Special Leave to Appeal (C) No(s).23608 of 2025 against this Court's order dated 1st July, 2025 review whereof is sought by the applicant herein. 5.

In that view of the matter, RVW 222 of 2025 is dismissed.

Consequently, all connected pending applications are also dismissed.

6.

There shall be no order as to costs.

7.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.) (Ajay Kumar Gupta, J.)
