The instant application despite under Section 482 read with 401 of the Code of Criminal Procedure praying for setting aside the proceeding of Sessions Case No.22 of 2009 pending before the Learned Additional District and Sessions Judge, Fast Track Court, Baolurghat, Dakshin Dinajpur arising out of Tapan Police Station Case No. 147 /08 dated 1.10.2008.

On perusal of the instant application along with annexures, it appears that there are materials against the present petitioner, which does not warrant exercise of the jurisdiction under Section 482 read with Section 401 of the Code of Criminal Procedure.

Accordingly, the instant application is dismissed on merit.
