The petitioner claims that the private respondent is creating nuisance and letting in drainage water on their land. There is a pending civil suit being Title Suit No.449 of 2016 instituted by the petitioner.

Learned counsel for the State submits that an FIR has been registered in respect of the complaint filed by the petitioner and charge sheet has been issued. Counsel for the private respondent submits that the private respondent has also instituted Title Suit No.113 of 2017, which is now pending before the learned Civil Judge, 2nd Court, Hooghly Sadar.

The parties may obtain appropriate orders in the said proceedings since the disputes are purely civil in nature.

However, Officer-in-Charge, Polba Police Station shall ensure that there is no breach of peace in the area.

With the aforesaid observations, the writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
