1. This writ petition has been filed alleging that the private respondents have put up illegal construction by converting a water body.

2. The learned advocate appearing for the private respondents submitted that this writ petition has been filed at the instance of the defendant in a suit for partition and the petitioner has been set up by the said defendant. He is further submitted that there are documents in favour of the private respondents and the construction has been done in the year 2005 and it is not an encroachment in a water body and the private respondents are also enjoying electricity service connection.

3. Thus, it appears there is a complaint made by the writ petitioner.

4. In any event, the construction which has been in existence for several decades.

5. Therefore, we are not inclined to entertain this public interest writ petition.

6. Accordingly, the writ petition stands dismissed.
